Judging in Israel - Balancing Contradictions

Presenter: Justice Eliezer Rivlin, Vice-President of the Supreme Court of Israel

The state of Israel is characterized by many conflicts: contradiction of ideas, differences of
beliefs, divergence of opinions as to the national identity and clashes regarding the nature of the state.
These conflicts are a result of the many ethnic groups in the country, the various religions observed in Israel, the extreme socio-economical differences and of the complex reality in which the state is constantly required to handle complicated security challenges.

Lucinda Lecture

‘Section 92:  markets, protectionism and proportionality – Australian and European perspectives’

Presenter: The Honourable Justice Susan Kiefel

Recent cases involving s.92 of the Constitution refer to economic considerations and principles relating to competition. The application of provisions of the EC Treaty having similar effect, by the European Court of Justice, has led to a broader consideration of the effects of State regulation on the ideal of a common market and a lessening of the relevance of domestic protection. It has tested what is permissible State regulation by the doctrine of proportionality. The paper will compare the current Australian perspective.

Staff Seminar
"Academic employees and their university employers: who owns the inventions they create?"

Presenter: Professor Ann Monotti, Faculty of Law

In the context of the recent full federal court decision in UWA v Gray, this seminar discusses the general issue of ownership of inventions created by academic employees and explores the legal implications of the decision for universities. In UWA v Gray, the university failed to enforce any express claim to own Professor Gray's inventions which resulted from his research at UWA. Consequently, it was forced to argue its entitlement on the basis of general legal principles: academic employees who have a duty to carry out research must assign any inventions they create arising from that research to the university. Both Justice French at first instance and the full federal court dismissed the argument, deciding that different principles apply to universities because of their special nature. They decided that a duty to carry out research does not necessarily incorporate a ‘duty to invent'. Universities who seek to own such inventions must assert those rights through express contractual provisions.

Presenter: Professor Justin Malbon

Unfair deals are prevalent, which does not serve the interests of the harmed party to a deal nor society more generally. The law tends to focus on providing the harmed party a means for gaining compensation for unfair deals. The focus on the harmed party distracts attention away from investigating the reasons and motivations for the stronger party offering and entering into unfair deals in the first place. In this lecture Professor Malbon addresses this deficiency by proposing a theory - coined "deal theory" - to explain "dealor" behaviours and motivations, as well as to offer insights into why we are suckers fora bad deal.
